隨著全球彩虹旗飄揚、過去遭歧視的同性戀族群(LGBT),也在逐漸平等對待後,敢於浮出檯面。但隨著接觸機會增加,卻同時讓衝突、矛盾和歧視案件層出不窮。
英國廣播公司(BBC)報導,一家位於英國北愛爾蘭首府貝爾法斯特(Belfast)的糕點店「Ashers bakery」,於2014年因信仰基督教的店主丹尼爾與艾咪・麥克阿瑟(Daniel and Amy McArthur)夫婦,拒絕為一名支持同性婚權的運動人士製作、刻有支持同性婚姻口號的蛋糕,因此遭到對方以歧視為由提告。

這場官司纏訟上訴多時,店主夫婦一度獲判有罪而另起上訴,直到本月10日、倫敦最高法院(Supreme Court)做出最後判決,負責審理的5名法官一致認為,店主麥克阿瑟夫婦並無歧視當事人之意,故在此案件中獲判無罪。

最高法院院長、何熙怡女男爵(The Baroness Hale of Richmond)在法庭上表示,「(他們)店舖有權決定是否製作任何糕餅的訂單,這與顧客的性取向並無關聯。法院認為,糕點店當時的決定,是針對該枚蛋糕,而非對提告人加雷思・李(Gareth Lee)個人,故判定店主夫婦在此歧視案中無罪。」

提告人加雷思・李在事件爆發時表示,糕點店讓他感到被輕忽和歧視,他的法律行動獲得北愛爾蘭性別平等委員會(Equality Commission of Northern Ireland)支持和協助。

但耗時長達4年、為打此案官司,性平會燒掉了公眾約15萬英鎊(約新台幣606萬元)稅金,而被告者夫婦也花費近20萬英鎊(約新台幣808萬元)的辯護費,不免讓英國媒體感嘆,「這真是英國史上最昂貴的一枚蛋糕!」

據英媒介紹,此案發生地的北愛爾蘭地區,是聯合王國(United Kingdom)內唯一拒絕、且尚未將同性婚姻寫入法律內的區域。
最高法院此次判決,獲得學界、政界和多數輿論的支持,認為此案例能協助、未來英國以更公正和平衡的方式處理雙邊的衝突。
不過,代表北愛爾蘭當地的國會議員皮斯禮二世(Ian Paisley Jr),卻透過推特大力砲轟性平會的角色,「我已向北愛爾蘭國務大臣寫信,要求重新審視性平會的預算!在此一「蛋糕」案落幕後,我希望他們(性平會)能醒悟,不要再浪費大眾的稅金了!」
